Important: Bright Loan Capital collects the information you provide through forms on the Bright Loan Capital website to help match you with a personal loan lender based on your full application. While we are able to assist many users in connecting with a mortgage lender, approval is not guaranteed.
Some loan providers in our network are able to issue pre-approvals without performing a credit check, while others may issue pre-approvals or approvals through a soft credit inquiry, which does not affect your credit score. Once matched with a lender, they may request additional information from you, including your Social Security Number, if a soft credit inquiry is required. Soft inquiries have no impact on your credit score. For final approval and funding of your loan, certain lenders may require a hard credit inquiry. By submitting an application for a loan product that requires a credit check, you provide written consent under the Fair Credit Reporting Act authorizing Bright Loan Capital and any lenders you are matched with to obtain consumer report information from your credit profile or from our contracted credit bureau. You understand and agree that you are applying for credit and that Bright Loan Capital and its network lenders may use your consumer report information for fraud prevention, security checks, and evaluating your application. You also understand that your application may be matched with multiple lenders, each of whom may obtain consumer report information.
Prospective lenders will review your application to determine whether they can offer you a mortgage loan. Bright Loan Capital does not guarantee that you will be matched with a lender in our network, nor does it guarantee approval from any lender. Each lender independently determines eligibility according to its own loan program requirements.
Bright Loan Capital is not a lender and does not make loan or credit decisions. Completing an application does not guarantee approval. Our website attempts to match you with a lender based on your application. This service is not available in all states, and the states served by this website may change without notice.
Accessing the Site
You may use the site only if you reside in the United States and are at least 18 years old. We reserve the right, for any reason and at our discretion, to modify, suspend, or discontinue any aspect of the site. We may also limit certain features or restrict your access to part or all of the site without notice. Bright Loan Capital does not charge users to access the site and does not collect any fee upon successful completion of a mortgage loan.
User Data and Consent to Contact
While using the site, you may be asked to provide information or materials (“User Data”), including information submitted within a loan application. Our collection and use of User Data is governed by our Privacy Policy, which is incorporated into these Terms. Please review the Privacy Policy before submitting any information. You are solely responsible for the accuracy and content of your User Data. We are not responsible for maintaining any User Data you provide and may delete it at any time. We reserve the right to refuse or remove User Data that we determine, in our discretion, to be unlawful, inappropriate, or in violation of these Terms.
By providing your contact information through the site, you agree to receive electronic communications from us and understand that electronic delivery satisfies any legal requirement for written communication. By applying for a loan product through the site, you consent to be contacted by lenders in our network by email, phone, or other communication methods. Any request to opt out from a lender’s communications must be made directly to that lender.
You expressly authorize the lender you are matched with to share relevant transaction history with its affiliates, loan servicers, and bank partners for the purpose of evaluating you for credit.
Disclaimer of Warranties
The information and services on this site are provided “as is” and for informational purposes. Bright Loan Capital makes no representations or warranties that the site will meet your needs or that the information provided is accurate, complete, current, reliable, or free from errors. All express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, are disclaimed.
Limitation of Liability
In no event shall Bright Loan Capital or its directors, officers, employees, agents, affiliates, or service providers (collectively, the “Protected Entities”) be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of, or inability to use, the site or its services, including lost revenue, even if advised of the possibility of such damages. Our total liability to you for all claims shall not exceed five dollars ($5.00). These limitations may not apply in all jurisdictions. If you do not agree with these limitations, your sole remedy is to discontinue use of the site.
Agreement Not to Bring or Participate in Class Actions
To the extent permitted by law, you agree not to bring, join, or participate in a class action related to any claim against us or our affiliates. You agree that we may seek injunctive relief to enforce this agreement and that you will be responsible for our associated attorney’s fees and costs. This agreement does not waive your right to pursue an individual claim through binding arbitration. This agreement survives the closing or repayment of any loan you apply for.
Agreement to Arbitrate All Disputes
To the extent permitted by law, any claim or dispute arising from your use of the website or the services provided by Bright Loan Capital shall be resolved by arbitration in Orange County, California before a single arbitrator selected by Bright Loan Capital. Judgment on the arbitration award may be entered in any court of competent jurisdiction. This does not prevent either party from seeking injunctive relief.
Updates
These Terms and Conditions may be updated at any time. Any modifications become effective upon posting to the site. Continued use of the site following such updates constitutes acceptance of the revised Terms.
Applicable Laws
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict-of-law principles. If any provision is found to be invalid or unenforceable, the remaining provisions remain in full force. Any dispute must be brought exclusively in state or federal courts located in California. You are responsible for complying with local laws if accessing the site from outside California. Any claim arising from use of the site must be filed within one year of the event giving rise to the claim.
